Scan Clan ("Scan Clan", "we", "us", "our") respects your privacy. This Privacy Policy describes the categories of information we may collect in connection with the Scan Clan mobile, desktop and web applications and any other digital services or facilities operated or used by Scan Clan from time to time (collectively, the "Services"), and how that information may be used.
By downloading, installing, accessing or using the Services, you consent to the collection, use, storage and disclosure of information as described in this Privacy Policy. If you do not agree, you must immediately terminate use of the Services.
This Privacy Policy forms part of, and must be read together with, the Terms of Use. Capitalised terms not defined here have the meaning given to them in the Terms of Use.
Scan Clan reserves the right to revise this Privacy Policy at any time in its sole discretion by publishing a revised version within the Services. Your continued use of the Services signifies your acceptance of the Privacy Policy published at the time of your use. You will be responsible for regularly reviewing the Privacy Policy published within the Services. The current version is always available at Settings → Privacy Policy.
Information We May Collect
We may collect the following categories of information:
- Account information — information provided when you register or link a third-party account, such as your e-mail address and name, and information necessary to secure your account.
- Content — documents, pages, signatures and associated information that you scan, import, create, edit or store using the Services, where you choose to back them up.
- Preferences — the settings and options you select within the Services.
- Communications — feedback, ratings, support requests and any other material you submit to us.
- Usage, technical and diagnostic information — information relating to how the Services are accessed and how they perform, including, without limitation, device, platform and application information, language, performance and timing measurements, measurements relating to the operation of automated features, and error and crash information.
- Registration information — information collected at the time of registration, including, without limitation, network address information and information derived from it, such as country.
The above describes categories of information and is not an exhaustive list. We may collect such other information as is reasonably necessary to operate, secure, support and improve the Services.
Information Processed on Your Device
Certain features of the Services, including document edge detection and text recognition, are performed on your device. Where a feature is performed on your device, the material it operates on is not transmitted to us for that purpose.
Documents that you do not choose to back up remain on your device and are not transmitted to us.
How We May Use Information
We may use information for any purpose connected with the operation of the Services, including, without limitation, to:
- provide, operate, maintain, support and improve the Services;
- store, back up and synchronise your content between your devices;
- authenticate you and protect the security of your account;
- prevent, detect and investigate abuse, fraud, security incidents and breaches of the Terms of Use;
- respond to your communications and support requests;
- diagnose, reproduce and remedy defects;
- compile aggregated or anonymised statistics, which do not identify you and which we may use and disclose for any purpose; and
- comply with applicable law and establish, exercise or defend legal claims.
What We Do Not Do
- We do not sell your personal data.
- We do not display advertising within the Services, and we do not share information with advertising networks.
- We do not use a third-party product-analytics service, and we do not track your behaviour within the Services for marketing or profiling purposes.
- We do not use the contents of your documents to train machine-learning models.
- We do not access the contents of your documents except where necessary to provide the Services to you, where you direct us to do so, or where required by law or to protect rights as described below.
Crash Reporting and Diagnostics
If the application crashes or encounters an error, a diagnostic report may be sent to a third-party error-tracking provider so that the fault can be diagnosed and fixed. A report contains the device model, operating system version, application version, the error and its stack trace, and a short trail of recent in-application actions such as which screen you were on. File paths and file names are removed before a report is sent.
On Android and iOS, a masked recording of the application's screen may be included with a report. Document pages and the text you enter are obscured before the recording leaves your device; the recording exists to show the sequence of actions that led to a fault. Reports and recordings are sent from released versions of the application only.
Disclosure of Information
We may disclose information:
- to service providers, contractors and other third parties engaged to perform functions on our behalf, to the extent necessary for them to perform those functions;
- to our personnel, to the extent necessary to operate, administer, secure and support the Services;
- where you direct or authorise us to do so, including when you share or export a document;
- where required or permitted by any applicable law, regulation, legal process or governmental or regulatory request;
- where we consider it necessary to establish, exercise or defend legal claims, to enforce the Terms of Use, or to protect the rights, property or safety of Scan Clan, our users or any other person; and
- in connection with any merger, acquisition, restructuring, financing or sale of assets, in which case information may be transferred as part of that transaction.
Service Providers
We engage third parties to provide infrastructure, authentication, storage, diagnostic and related services that the Services depend upon. Those providers process information only as necessary to perform the functions for which they are engaged. The providers we use may change from time to time without notice to you.
International Transfers
Information may be stored, transferred to and processed on infrastructure located outside your country of residence, where data protection laws may differ from those of your jurisdiction. By using the Services you consent to such transfer, storage and processing.
Security
We take such technical and organisational measures as we consider reasonable to protect information against unauthorised access, alteration, disclosure or destruction.
No method of transmission over the internet, and no method of electronic storage, is completely secure. We do not warrant, guarantee or represent that information will remain secure, and to the fullest extent permitted by law we disclaim all liability arising from any unauthorised access to, loss of, or alteration of information. You provide information at your own risk.
You are responsible for the security of the device on which the Services are installed and for the confidentiality of your login credentials. Where a document is confidential or sensitive, you should use the password protection offered when exporting or sharing it, and you should secure your device with its own lock screen.
Retention
We retain information for as long as we consider necessary for the purposes described in this Privacy Policy, for as long as your account exists, and thereafter for such period as is necessary to comply with applicable law, to resolve disputes, to prevent abuse, and to establish, exercise or defend legal claims.
Your Choices
- Delete a document. Deleting a document within the Services removes it from our servers, subject to the retention provisions above.
- Delete your account. Email support@spirikle.com from the address your account uses and ask us to delete it. We remove your account and the data attached to it from our servers. This cannot be undone.
- Sign out. Signing out clears the application's local copy of your data on that device.
- Keep a document off our servers. A document you do not choose to back up remains on your device and is not transmitted to us.
Depending on your jurisdiction you may have additional rights in respect of your personal data. To make a request in respect of any such right, contact us at support@spirikle.com. We may require information sufficient to verify your identity before acting on a request, and may decline a request to the extent permitted by applicable law.
Third-Party Services
The Services may interoperate with, or contain links to, services operated by third parties, including sign-in providers and the applications to which you choose to share or export a document. Scan Clan does not control and is not responsible for the privacy practices of any third party. Their handling of information is governed by their own terms and policies, which you should review.
Children
The Services are not directed at children under the age of 13, and we do not knowingly collect personal data from them. If you believe a child has provided us with personal data, contact us at support@spirikle.com.
No Warranty
This Privacy Policy describes our practices; it does not create any contractual or other legal right in favour of any person. Nothing in this Privacy Policy extends, or shall be construed to extend, the warranties or liability accepted by Scan Clan under the Terms of Use, and the disclaimers and limitations of liability in the Terms of Use apply equally to this Privacy Policy.
Changes to this Privacy Policy
We may revise this Privacy Policy from time to time. The revised version will apply from the date of its publication within the Services. Where a revision is made, the Services may display a notice; your continued use of the Services after such publication constitutes acceptance of the revised Privacy Policy, and it remains your responsibility to review the current version.
Governing Law and Dispute Resolution
This Privacy Policy shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or in connection with it shall be settled through arbitration in accordance with the dispute resolution provisions of the Terms of Use, the seat of arbitration being Chandigarh, India.
